Hearing & Review

Your Best Opportunity: Administrative Hearing and Appeals Council Review

If your initial application for Social Security Disability or Supplemental Security Income benefits is denied – and most applications are denied – here are the next steps available to you. You must take action to request them, and you must prepare for them.

Administrative Hearing: When your initial application is denied, you have 60 days to ask for an administrative hearing.

  • An Administrative Law Judge will consider medical evidence from your doctors and testimony offered by you.
  • The judge bases his decision on the evidence before him, ignoring previous denials and the reasons for them.
  • The hearing is informal and represents the best opportunity to have your application approved at the administrative level.

Appeals Council Review: If your appeal at your hearing is unsuccessful, you have 60 days to ask for an Appeals Council Review.

  • You can send in written argument that we help you prepare.
  • You may supply new evidence to be considered.
  • The Social Security Administration Appeals Council will review your file and documentation you submitted.
